What rights do you have in relation to the personal information Experian holds?

Data protection law ensures that your personal data is used properly and legally by all organisations. In South Africa, you have various rights under the NCA and POPIA.

Under the NCA, you have the following rights

  • The right to apply for credit without discrimination.
  • The right to know why credit has been refused.
  • The right to receive your information in plain and understandable language.
  • The right to confidentiality.
  • The right to a free credit report once a year.
  • The right to challenge information held by a credit bureau without charge.

Under POPIA, you have the following rights

  • Right to rectification: correct anything that you think is wrong with the personal information we hold about you
  • Right to restrict processing: change how your personal information is used
  • Right to object: ask us to stop using your data
  • Right to be informed: understand what happens to your personal information
  • Right of access: see what personal information we hold about you
  • Right to erasure: ask us to delete your personal information

Whilst we consider all data subjects' rights' requests individually and, on a case-by-case basis, not all of these rights apply to the data we hold in our database. For example, where the information is processed in terms of a regulatory obligation under the NCA, those rights cannot be exercised.
